CONTEST RULES AND REGULATIONS
PANDA GAME CONTEST 2019
PARTICIPATION IN THIS CONTEST CONSTITUTES YOUR FULL AND UNCONDITIONAL ACCEPTANCE OF, AND AGREEMENT TO BE LEGALLY BOUND BY, THESE CONTEST RULES AND REGULATIONS (THE “CONTEST RULES”).
1. Contest Period
a) The Contest is open from October 5, 2019 at 10:30 a.m. to October 8, 2019 at 11:30 a.m. (“Contest Period”). The Contest Period is composed of two stages:
- Entry Period: Begins on October 5, 2019 at 10:30 a.m. and ends on October 5, 2019 at 11:30 a.m.
- Finalist Selection and Prize Announcement: Begins on October 5, 2019 at approximately 12:00 p.m. (“Draw Time”) during the inter-scholastic football game known as the Panda Game (“Panda Game”) taking place at the sports and entertainment complex, known as TD Place, located at or about 1015 Bank Street, within Lansdowne Park in Ottawa, Canada (“Venue”), and ends when the Prize (as defined below) is awarded, and no later than October 8, 2019 at approximately 11:59 p.m.
- The Contest is open to Canadian residents only, excluding residents of Quebec, and who have reached the legal age of majority in their province or territory of residence at the time of entry.
- The Contest is open only to students actively enrolled on a full-time basis for the 2019-2020 academic year at one of (i) University of Ottawa, or (ii) Carleton University, each a “Host University”.
- Entrants must be individuals. Groups, clubs, organizations, businesses and commercial/non-commercial entities are ineligible.
- Employees, and those with whom such employees are domiciled, of TD Place, a Host University. and any of their affiliated companies or agents are ineligible.
3. How to Enter
a) Entrants may participate in this Contest as follows:
i. Panda Game Attendees: All individuals meeting the eligibility requirements of Section 2 above, will be entered to the Contest by having their valid ticket to attend the Panda Game (“Ticket”) scanned by Venue staff upon entry to the Venue during the Entry Period of 10:30 am and 11:30 a.m. on October 5, 2019. One (1) entry entered into the Contest per scanned Ticket.
ii. Alternative Entry: All individuals meeting the eligibility requirements of Section 2 above, may enter without having to having to obtain a Ticket, by sending by mail a 1,000-word (or more) essay on the following topic: “Why I Love Inter-Scholastic Football” (“Essay Entry”). All Essay Entries must be legible and complete. All Essay Entries must include the entrant’s name and email address. Any content deemed by TD Place to be inappropriate or not suitable for its audience for any reason will be disqualified at the sole discretion of TD Place. All Essay Entries must be addressed to:

Each valid entry to the Contest is an “Entry”, and each individual with an Entry is an

c) All Entries must be received before October 5, 2019 at 11:30 a.m.
4. Finalist Selection and Announcement.
a) A random draw (“Draw”) will be held during the Draw Time from among all eligible Entries received during the Contest Period to select one (1) Finalist. The odds of being selected as a Finalist will depend on the number of eligible Entries. The selected Finalist’s Ticket or corresponding seat location will be displayed on video score boards throughout the Venue during the Panda Game. The Finalist (or their designated and authorized proxy) must the present themselves in-person to the Guest Service booth at the Venue, or to where otherwise be directed by TD Place. If the Finalist fails to do so, then he/she will be disqualified (and will forfeit all rights to the Prize), even if his/her name may have been publicly announced; forfeited Prize will not be awarded to the Finalist. In such an event, TD Place, at its sole and absolute discretion, may select another eligible Entrant as a Finalist, in which case the foregoing provisions of this section shall apply to such newly selected Finalist.
b) Prior to being awarded the Prize, the Finalist will be required:
- to provide a valid student identification card confirming current and active enrollment in a
- to provide a valid statement from a Host University demonstrating tuition charges for the
2019-2020 academic calendar year;
- to sign a declaration of eligibility and a liability/publicity release, which (among other

c) If the Finalist provides the foregoing, they will be declared the “Prize Winner” and awarded the Prize. If the Finalist fails to provide the above, or otherwise violates these Contest Rules (as determined by TD Place in its sole and absolute discretion), they will be disqualified and will forfeit all rights to the Prize. In such an event, TD Place, at its sole and absolute discretion, may select another eligible Entrant as a Finalist, in which case the foregoing provisions of this section shall apply to such new selected Finalist.
a) “Prize”: There will be one (1) Prize. The Prize consists of the following benefits:
- TD Place will contribute the Prize Winner’s demonstrated tuition costs, up to a maximum of $7,000 CAD (in the event tuition costs are less than $7,000 CAD, TD Place will contribute the actual amount).
b) The Prize Winner shall remain liable for any deficiencies, additional charges, and any other liabilities pursuant to their tuition costs.
c) The actual value of the Prize will depend on the invoiced tuition costs, but in no event will the value of the Prize exceed $7,000 CAD.
a) “TD Place” as used in these Contest Rules means Lansdowne Stadium Limited Partnership.

c) By entering the Contest, each Entrant agrees to abide by these Contest Rules. This Contest is subject to all applicable federal, provincial and municipal laws. Void where prohibited by law. The decisions of TD Place with respect to all aspects of this Contest are final and binding on all entrants without right of appeal.
d) By submitting an Entry to the Contest, each Entrant agrees to communicate with TD Place electronically and agrees that the act of submitting the Entry to the Contest is a binding form of your electronic signature, which you agree binds you to these Contest Rules.
e) By submitting an Entry to the Contest, each Entrant agrees to release TD Place, the Host University, their affiliated companies and agents, advertising and promotion agencies, and each of their respective officers, directors, agents, representatives, successors and assigns (“Contest Parties”) from any liability in connection with the Contest, the Finalist’s participation therein and/or the awarding and use or misuse of the Prize or any portion thereof.
f) By submitting an Entry to the Contest, each Entrant agrees to indemnify the Contest Parties against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her Entry including, without limitation, any claim that the Entry infringes a proprietary interest of any third party.
g) By submitting an Entry to the Contest, each Entrant agrees to the publication, reproduction and/or other use of his/her name, photograph, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of TD Place and the Host Universities in any manner whatsoever, including print, broadcast or the internet, worldwide and in perpetuity and grants to TD Place the right to use the Entrant’s name and likeness in any form of advertising carried out by or on behalf of TD Place in any manner whatsoever, including print, broadcast or the internet, relating to the Contest without further notice or compensation, and waives all moral rights thereto.
h) By submitting an Entry to the Contest, each Entrant agrees expressly consents to TD Place and the Host Universities, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest.
i) TD Place reserves the right to cancel, suspend, withdraw or amend this Contest in any way, without prior notice or obligation, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of TD Place that interferes with the proper conduct of this Contest as contemplated by these Contest Rules. Any attempt to deliberately undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, TD Place reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
k) All Entries are subject to verification at any time and for any reason. TD Place reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to TD Place – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason TD Place deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Contest Rules. Failure to provide such proof to the satisfaction of TD Place in a timely manner may result in disqualification in the sole and absolute discretion of TD Place. The sole determinant of the time for the purposes of this Contest will be the Contest server machine(s). Entries will not be returned or acknowledged.
l) Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise, illicit means to enter the Contest, or any other methods not authorized by these Contest Rules, for example, but not limited to, creating multiple email accounts, shall be deemed as tampering and may disqualify you from entering, participating, winning the Prize, and preclude you from participating in future contests and promotions, at the sole discretion of TD Place. Entries that are late, contain false information, or that do not conform with or satisfy any or all of the conditions these rules will be judged void. All Entries become the property of TD Place upon receipt and none will be returned. Proof of transmission (screenshots or captures, etc.) does not constitute proof of receipt.
m) Without limitation, the Contest Parties will not be liable for any failure of websites used during the Contest; for a technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; for the failure of any Entry to be received by TD Place, for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website; or any combination of the above. Further, the Contest Parties will not be liable for any injury or damage to an Entrant’s or any other person’s computer related to or resulting from participating or downloading any material in the Contest.
n) The Prize may not be exchanged or transferred to a third party.
o) All times referred to in these Contest Rules will be in Eastern Daylight Time.

q) In the event of any discrepancy or inconsistency between the terms and conditions of these English Contest Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: website and/or point of sale, television, print or online advertising; French version of these Contest Rules, and/or any instructions or interpretations of these Contest Rules given by any representative of TD Place; the terms and conditions of these English Contest Rules shall prevail, govern and control to the fullest extent permitted by law.
r) The invalidity or unenforceability of any provision of these Contest Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Contest Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein. To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Contest Rules or the rights and obligations of participants, TD Place or any of the other the Contest Parties in connection with the Contest will be governed by and construed in accordance with the domestic laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. The parties hereby consent to exclusive jurisdiction and venue of the courts located in Ontario in any action to enforce (or otherwise relating to) these Contest Rules or relating to this Contest.
